Welcome to H'Urban Apothika. These Terms of Service ("Terms") govern your use of our store, our website, and the products you purchase from us. By placing an order, creating an account, or using the store in any way, you agree to these Terms. Please read them carefully.

If you do not agree, please do not use the store.

1. Who We Are

H'Urban Apothika ("HUA," "we," "our," "us") is a sole-proprietorship herbal goods business operating from California. Our store is hosted on Shopify and we currently sell to customers within the United States only.

2. Eligibility and Accounts

You must be at least 18 years old to place an order or create an account. By using the store, you represent that you are 18 or older and that the information you provide is accurate.

If you create an account, you are responsible for keeping your login credentials confidential and for any activity that occurs under your account. Notify us at info@bveats.com promptly if you believe your account has been compromised.

We may suspend or close any account that we reasonably believe is being used in bad faith — for example, repeated chargebacks, fraudulent orders, or abusive communication with our team or community.

3. Orders, Pricing, and Payment

Placing an order. When you place an order, you are making an offer to buy the listed products at the listed prices. We accept your offer when we send an order-confirmation email or ship the product. We may decline or cancel any order before shipment for any lawful reason — including pricing errors, suspected fraud, ingredient shortages, or compliance issues. If we cancel an order you have already paid for, we will issue a full refund.

Pricing. All prices are listed in U.S. dollars. We do our best to keep pricing accurate, but typographical and system errors do occur. If we discover an obvious error after you place an order, we will contact you with the corrected price; you may proceed at the corrected price or cancel for a full refund.

Taxes. Sales tax is added at checkout where applicable based on your shipping address.

Payment. Payment is processed through our payment providers (Stripe, via a Shopify-listed third-party gateway app, and PayPal). We do not store full card numbers ourselves. By placing an order, you authorize us (and our processor) to charge the payment method you provide for the full order total, including any applicable shipping and tax.

4. Subscriptions and Recurring Orders

If you select a subscription option, you authorize us and our subscription platform (Loop Subscriptions) to charge your payment method automatically on the schedule you select, until you cancel.

You can cancel, pause, or modify your subscription at any time through your account portal — no questions asked.

To prevent an upcoming charge, please make changes at least 24 hours before your scheduled renewal. Once a charge has processed, it cannot be reversed, but the next billing cycle can still be canceled or skipped.

For exchanges or damage handling on subscription orders, our Refund / Exchange Policy applies the same as it does to one-time orders.

5. Shipping and Delivery

We ship to U.S. addresses only at this time. Processing typically takes 2–5 business days from order placement. Once a carrier picks up the order, delivery times depend on the carrier and your location. Tracking is provided when available.

6. Returns, Exchanges, and Damaged Orders

Our Refund / Exchange Policy is incorporated into these Terms by reference. In short:

  • Sealed, unopened items can be exchanged within 30 days of delivery.
  • Opened, used, or partially consumed goods cannot be returned or exchanged, for the safety of every customer.
  • Damaged or incorrect orders are made right at no cost when reported within 7 days of delivery, with photo documentation.

7. Intellectual Property

All content on this store — product descriptions, photographs, illustrations, blend names, recipes, formulations, logos, brand marks, and the H'Urban Apothika name — is owned by H'Urban Apothika or used with permission. It is protected by copyright, trademark, and trade-secret laws.

You may: view and share our public content (e.g., share a product page link to social media; quote a short product description with attribution).

You may NOT: copy, reproduce, republish, or redistribute our product photography, descriptions, recipes, or formulations without our written permission. You may not scrape the store, use it to train machine-learning models, or use our content to create or market a competing product.

8. User-Generated Content (Reviews, Photos, Social Tags)

When you submit a product review, send us a photo, tag us on social media, or otherwise share content with us, you grant H'Urban Apothika a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and adapt that content for marketing and promotional purposes — including on our website, in email, and on social channels — with credit where reasonable.

You represent that:

  • The content is yours to share (you took the photo, wrote the review, etc.).
  • It does not violate the rights of any third party.
  • It does not contain unlawful, defamatory, hateful, or sexually explicit material.

We reserve the right to remove or refuse to publish any submitted content for any reason.

9. Health, Wellness, and Limitation of Liability — Please Read Carefully

H'Urban Apothika products are herbal goods, not pharmaceuticals or medical devices. They have not been evaluated by the U.S. Food and Drug Administration. They are not intended to diagnose, treat, cure, or prevent any disease.

Information shared on our store, in our newsletters, or by our team is provided for educational purposes as part of a plant-based herbal wellness tradition. It is not a substitute for medical advice, diagnosis, or treatment by a licensed healthcare provider.

Herbal products affect every individual differently. You are responsible for consulting a qualified healthcare practitioner before beginning any new herbal regimen — especially if you have an underlying health condition, are taking medications, are pregnant or nursing, or are giving the product to a minor.

To the fullest extent permitted by law, H'Urban Apothika is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products, our store, or our content — including any individual response, side effect, allergic reaction, or outcome that you experience. Our maximum aggregate liability for any claim arising from a product or order is limited to the amount you paid for that product or order.

Some jurisdictions do not allow certain limitations of liability; in those jurisdictions our liability is limited to the maximum extent permitted by law.

You agree to indemnify and hold harmless H'Urban Apothika and its owners, affiliates, contractors, and vendors from any third-party claim arising out of your misuse of our products, your violation of these Terms, or your violation of any law or third-party right.

10. Disclaimers

THE STORE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE STORE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

We do not warrant any specific health outcome from using our products. Results vary by individual.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Informal resolution first. If you have a dispute with us, please email info@bveats.com first. We aim to resolve issues directly and promptly. Most issues can be solved with a conversation and good faith on both sides.

Binding arbitration. If a dispute cannot be resolved informally within 60 days, you and HUA agree that the dispute will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Los Angeles County, California. Arbitration is faster and less expensive than court for both sides. Each party bears its own attorney's fees, except where the AAA rules or applicable law require otherwise. The arbitrator's decision is final and enforceable in any court of competent jurisdiction.

No class actions. You and HUA both agree that disputes will be resolved on an individual basis only and not as part of a class action, collective action, or representative proceeding.

Exceptions. Either party may bring a small-claims action in lieu of arbitration, and either party may seek injunctive relief in court for misuse of intellectual property.

30-day opt-out. You may opt out of the arbitration agreement above by emailing info@bveats.com within 30 days of first agreeing to these Terms (e.g., your first order). Your opt-out must include your name, order number, and a clear statement that you opt out of arbitration.

12. Changes to These Terms

We may update these Terms from time to time. The "Effective date" at the top reflects the latest change. Material changes will be announced via email (if you are subscribed) or a prominent notice on the store. Continued use of the store after changes take effect means you accept the updated Terms.

13. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms (together with our Privacy Policy, Refund Policy, and Shipping Policy) are the entire agreement between you and HUA regarding your use of the store.
